These General Terms of Use (hereinafter "GTU") govern access to and use of the website https://hfe-energie.fr (hereinafter "the Site"), published by HECKER & FRERES ENERGIE (Hecker & Frères Énergie (HFE)).

Use of the Site implies full and unreserved acceptance of these GTU by any visitor (hereinafter "the User"). In the event of disagreement, the User is invited to leave the Site immediately.

Article 1 - Purpose of the Site

The Site is intended to:

  • Present the activity, services and expertise of Hecker & Frères Énergie (HFE)
  • Inform visitors about heating, air-conditioning and plumbing solutions
  • Enable contact via a dedicated form
  • Provide information on energy renovation grants

The Site is a showcase website: no sales or online payments are made on it. Any service is governed by the Terms of sale, after acceptance of a personalised quote.

Article 2 - Access to the Site

The Site is accessible free of charge to any User with internet access. Costs relating to such access (equipment, software, subscription) remain solely at the User's expense.

Hecker & Frères Énergie (HFE) endeavours to ensure Site availability 24/7, but cannot guarantee uninterrupted accessibility. The Site may be temporarily unavailable for maintenance, updates, or in the event of force majeure. Hecker & Frères Énergie (HFE) shall not be liable for the consequences of such unavailability.

Article 3 - User conduct

The User undertakes to use the Site fairly, in accordance with its purpose and applicable law. The User is prohibited in particular from:

  • Compromising the security or integrity of the Site
  • Collecting or using data on the Site for commercial or malicious purposes (scraping, spam, etc.)
  • Disseminating unlawful, defamatory, insulting, racist content or content undermining public order via the contact form
  • Using the Site to transmit or propagate viruses, malware or any other harmful computer code
  • Attempting to access non-public areas of the Site

Any breach of these rules may result in blocking of access to the Site and engage the User's civil and/or criminal liability.

Article 4 - Intellectual property

All elements comprising the Site (text, images, photographs, logos, trademarks, videos, diagrams, graphic charter, source code, databases, etc.) are protected by intellectual property law. These elements are the exclusive property of HECKER & FRERES ENERGIE or its partners.

Any reproduction, representation, modification, publication, transmission, distortion, in whole or in part of the Site or its content, by any means and on any medium, is strictly prohibited without prior written authorisation from HECKER & FRERES ENERGIE, on pain of proceedings under Articles L.335-2 et seq. of the French Intellectual Property Code.

Any unauthorised use of the Site or any of its elements shall be deemed infringement.

Article 5 - Hyperlinks

5.1 Outgoing links

The Site may contain hyperlinks to third-party sites (partners, public bodies, manufacturers, etc.). HECKER & FRERES ENERGIE exercises no control over these sites and declines all liability for their content, data protection practices or availability.

5.2 Incoming links

Creation of hyperlinks pointing to the Site is permitted provided that:

  • No confusion is created as to the source or nature of the content
  • The Site is not used in a manner contrary to good morals or damaging to the image of Hecker & Frères Énergie (HFE)
  • The source (Hecker & Frères Énergie (HFE)) is clearly stated

HECKER & FRERES ENERGIE reserves the right to request removal of any link it deems inappropriate.

Article 6 - Contact form

The contact form on the Site is intended to collect information and quote requests from Users. The User undertakes to provide accurate, complete and up-to-date information. Transmission of deliberately false or fraudulent information may result in no response and engage the User's liability.

Article 8 - Limitation of liability

Information on the Site is provided for guidance only and has no contractual value. HECKER & FRERES ENERGIE endeavours to keep this information up to date and accurate, but cannot guarantee its completeness or absence of error.

In particular, estimates provided by the savings simulator (heat pump savings calculator), grant amounts (MaPrimeRénov', CEE) and intervention deadlines mentioned on the Site are indicative. Only a personalised quote following a technical assessment constitutes a contractual commitment.

HECKER & FRERES ENERGIE shall not be liable for direct or indirect damage resulting from use of the Site, except in the event of gross negligence or wilful misconduct.

Article 9 - Security

HECKER & FRERES ENERGIE implements reasonable means to ensure Site security: HTTPS encryption, professional hosting, regular updates. However, the User acknowledges that no information system is completely infallible and that each person must take all appropriate measures to protect their own equipment.

Article 10 - Amendment of the GTU

HECKER & FRERES ENERGIE reserves the right to amend these GTU at any time to adapt them to developments of the Site, services offered or legislation. The applicable GTU are those in force on the date of consultation. Users are therefore invited to consult them regularly.

Article 11 - Governing law & jurisdiction

These GTU are governed by French law. In the event of a dispute relating to their interpretation or performance, the parties shall endeavour to find an amicable solution. Failing that, the dispute shall be brought before the competent French courts of the registered office of HECKER & FRERES ENERGIE.
